ARTICLE II: OBJECTIVES OF THE PARTY

The objectives of the Party shall be to start contesting elections within five years of its formation and implement the following sub objectives in the territories it comes to the power:

1. Devising Innovative Governance Strategies: To devise the principles and conceptualising on strategies to bring spirit of true democracy, accountable for promoting overall well-being of the citizens.
2. Bringing Transparency: To bring advanced level transparency in the affairs of the government by optimum use of the technologies.
3. Maximising People Participation: To create an ideal model of governance in the country through maximising people’s participation within defined parameters, as envisioned in the Constitution of India.
4. Enhanced Accountability and Increased Index of Happiness: To make every role accountable for their respective jurisdictions with complete empowerment and endeavour to increase the happiness index of the citizens.
5. To do all other things as may be deemed necessary to meet the above sub-objectives.

CORE PRINCIPLES

1. All the Members and Associates of the Party shall work beyond individual expectations, selflessly and tirelessly, beyond the call of their duty, regardless of the outcome of winning or losing, bringing the reforms in the system, for overall development of the society and the country.
2. All the Members and Associates of the Party shall abstain from indulging in criticism of any individual, parties or the governments; instead they shall familiarise the people with the new working agenda, plans and priorities.
3. All the Members and Associates of the Party shall take oath before joining and periodically  as laid down to abide by the core principles and the bye-laws of the Party.
4. All the Members and Associates of the Party shall work for justice, social harmony and socio-economic prosperity through politics for everyone including the last person.
5. All the Members and Associates of the Party shall strive for equality of status and of opportunity, in all spheres of life, for individuals and communities and to promote same sentiments among all.
6. All the Members and Associates of the Party shall bear true faith and allegiance to the Constitution of India as established by law, and to the principles of Socialism, Secularism and Democracy and would uphold the Sovereignty, Unity and Integrity of India.

ARTICLE III: MEMBERSHIP OF THE PARTY

A. ELIGIBILITY FOR MEMEBRSHIP

Any citizen of India of the age of 18 years or above who subscribes to the objectives of the Party shall be eligible to become a member of the Party, provided that he or she:

1. Is not a member of another political Party registered with the Election Commission of India.
2. Is not a member of any organisation whose views, policies or actions are in conflict with the objectives of the Party; and/or.
3. Has not been convicted of any offence involving moral turpitude and anti-national activities.
4. Undertakes on oath to abide by the core principles of the Party in letter and Spirit and authorises the Party to make such oath public.

B. CATEGORIES OF MEMBERSHIP

The party shall have the following categories of members:

1. Ordinary member: Every person who becomes the member of the Party as per the procedure prescribed shall be an ordinary member. An ordinary member shall not have any voting rights.
2. Active member: A person who has been an ordinary member and who has undertaken Foundation Training of the Party shall be eligible to become an Active Member provided his / her Active Membership Application Form is recommended by two Active Members references and he / she follows the Code of Conduct for the members as prescribed by the Party from time to time. An Active Member shall have the right to vote.

C. MEMBERSHIP PROCESS

1. A person shall become an Ordinary Member of the Party on filling up the Membership Form along with membership fee, as be decided by the Party from time to time, and declaration / undertaking /oath as prescribed from time to time.
2. A person seeking Active Membership of the Party shall apply through the Active Membership Form duly recommended by two Active Members references and remits the requisite Active Membership fee.
3. The application shall be considered by the local Core Working Committee at Gram Panchayat or Municipality Ward concerned.
4. The Party shall maintain a register of its members in the manner as may be prescribed in the Regulations. The register and other information can be maintained online as well.
5. The list of Active Members shall be frozen one month before the call for applications of candidates for any Party election. Pending application, if any, for Active Membership shall be decided before freezing the list.
6. The National Unit, the State Unit and the District Unit shall have the powers to directly admit new members or confer the status of an Active Member on any person. However, such power shall only be exercised by the District Unit when no Primary Unit is in  existence for a particular area.
7. Any person, who has been co-opted to a District Unit or in any body at the State or National Level, shall be deemed to have become an Active Member of the Party on completion of the procedural steps for becoming an Active Member.
8. If a District Unit /State Unit decides to grant membership of the Party to a person who had been a leader in another registered political party in the last ten years or is still a leader, such decision shall become operational only after approval by the National Unit. A leader here would mean either a State or National Level office bearer of another Party or someone who has contested Parliamentary  or Assembly or District Level Elections on the symbol of another party.
9. i) A person can become a member of the Party either at his/her place of permanent residence or where he/she carries on his/her business but at one time he/she shall not be a member at more than one place.
   j) If any active member changes the place of residence, the same should get reflected in the Members’ register.

D. TERM

The term of membership shall in principle be life-long unless the member resigns or cease to exist as member.

E. CESSATION OF MEMBERHIP

A person shall cease to be a member of the Party in the event of:

i. Death
ii. Resignation
iii. Expulsion/Removal;
iv. Declared lunatic or unsafe mind by medical authorities.
v. Joining any other political party
vi. One being convicted by a court of law for a crime involving moral turpitude

F. SUSPENSION FROM MEMBERSHIP

The State Unit or the National Unit may suspend an Active Member from the membership of the Party pending disciplinary proceedings.

ARTICLE IV: ORGANISATIONAL STRUCTURE

A. ORGANS OF THE PARTY

i) The organisational structure of the Party shall consist of the following organs at the Primary, Block, District, State and National Levels:

a. Primary Level

General House: All Members; Primary and Active Members of the Gram Panchayat Area / Municipality
Primary Level Core Working Committee: 2 Active Members with preferable 50% ratio of female from each Ward.
Office Bearers: There shall be three Office Bearers at Primary Level named Convenor, Joint Convenor (Org.) and Joint Convenor (Finance).

(a.1) Powers and Functions of the Primary Level Core Working Committee shall be to

1. Specifically work in the area of social audit, programme / plan implementation and local support.
2. Deliberate and decide on any issue or action program to further the objectives of the Party including electoral participation, opinion making and /or other constructive actions within the defined jurisdiction;
3. Approval of applications of Primary Members;
4. Elect one Convenor and one Joint Convenor (Org.) and one Joint Convenor (Finance) (out of which at least one shall be a woman) by consensus, failing which, it will be done by voting in the presence of a representative of the Block Level Core Working Committee.
5. The Convenor and Joint Convenor shall be available for the Party work on a regular basis.
6. Form such teams or sub-committee as required and assign them such work as deemed fit.
7. Reconstitute any team or sub-committee.
8. Recall Convenor or Joint Convenor.
9. Perform such tasks as assigned to it from time to time by the Party.

b. Block Level

General House: Two Active Members elected at the Primary Level with preferable 50% ratio of female from each Panchayat / Municipality.
Block Level – Core Working Committee: At least 25 Active Members with preferably 50% ratio of female.
Office Bearers: There shall be three Office Bearers at Block Level named Convenor, Joint Convenor (Org.) and Joint Convenor (Finance).

(b.1) Powers and Functions of the Block Level – Core Working Committee

1. Specifically work in the area of effective governance, development of Block Vision and grievance addressal.
2. A Block Level – Core Working Committee shall organise and coordinate the activities at the Block Level and shall raise public issues affecting more than one Primary Unit in that Block.
3. A Block Level – Core Working Committee shall exercise such powers and discharge such other functions as are assigned to it by the Party.
4. The members of a Block Level – Core Working Committee shall elect from amongst themselves or from amongst Active Member in that Block, one Convenor, one Joint Convenor (Org.) and one Joint Convenor (Finance) (out of which at least one shall be a woman) by consensus, failing which by voting in the presence of a representative of the District Level – Core Working
   Committee
5. The Block Level – Core Working Committee may form such teams as may be required for its activities and the discharge of its functions.
6. Convenor and Joint Convenor shall be available for the Party work on regular basis.
7. Reconstitute any team or committee.
8. Recall Convenor or Joint Convenor.

c. District Level

General House: Two Active Members elected at the Block Level CWC with preferable 50% ratio of female.
District Level – Core Working Committee: Minimum 3 and maximum 11 Active Members with preferably 50% ratio of female.
Office Bearers: There shall be three Office Bearers at District Level named Convenor, Joint Convenor (Org.) and Joint Convenor (Finance).

(c.1) Powers and Functions of the District Level – Core Working Committee

1. Specifically work in the area of project planning, development of District Vision and Resource Management.
2. A District Level – Core Working Committee shall organise and coordinate the activities at the Block Level and shall raise public issues affecting more than one Block.
3. A District Level – Core Working Committee shall exercise such powers and discharge such other functions as are assigned to it by the Party.
4. The members of a District Level – Core Working Committee shall elect from amongst themselves or from amongst Active Members in that District, one Convenor one Joint Convenor (Org) and one Joint Convenor (Finance) (out of which at least one shall be a woman) by consensus, failing which by voting in the presence of a representative of the State Level – Core Working Committee
5. The District Level – Core Working Committee may form such teams as may be required for its activities and the discharge of its functions.
6. Convenor and Joint Convenor shall be available for the Party work on regular basis.
7. Reconstitute any team or committee.
8. Recall Convenor or Joint Convenor.

d. State Level

General House: Two Active Members elected at the District Level CWC with preferable 50% ratio of female.
State Level – Core Working Committee: Minimum 7 and maximum 11 Active Members with preferably 50% ratio of female.
Office Bearers: There shall be three Office Bearers at State Level named Convenor, Joint Convenor (Org.) and Joint Convenor (Finance).

(d.1) Powers and Functions of the State Level – Core Working Committee

1. Specifically work in the area of policy formulation, development of State Vision and monitoring of the public services.
2. A State Level – Core Working Committee shall organise and coordinate the activities at the District Level and shall raise public issues affecting more than one District.
3. A State Level – Core Working Committee shall exercise such powers and discharge such other functions as are assigned to it by the Party.
4. The members of a State Level – Core Working Committee shall elect from amongst themselves or from amongst Active Members in that State, one Convenor, one Joint Convenor (Org) and One Joint Convenor (Finance) (out of which at least one shall be a woman) by consensus, failing which by voting in the presence of a representative of the National Level – Core Working Committee.
5. The State Level – Core Working Committee may form such teams as may be required for its activities and the discharge of its functions.
6. Convenor and Joint Convenor shall be available for the Party work on regular basis.
7. Reconstitute any team or committee.
8. Recall Convenor or Joint Convenor.

e. National Level

General House: Two Active Members elected at the State Level CWC with preferable 50% ratio of female.
National Level – Core Working Committee: Minimum 11 and maximum 51 Active Members with preferably 50% ratio of female
Office Bearers: There shall be three Office Bearers at National Level named Chief Convenor, Convenor (Admin) and Convenor (Finance).

(e.1) Powers and Functions of the National Level – Core Working Committee

1. Specifically work in the area of Accountability, development of National Priority Vision and Transparency of the public services.
2. A National Level – Core Working Committee shall organise and coordinate the activities at the State Level and shall raise public issues affecting the country.
3. A National Level – Core Working Committee shall exercise such powers and discharge such other functions as are assigned to it by the National General House.
4. The members of a National Level – Core Working Committee shall elect from amongst themselves or from amongst Active Members in the National General House, one National Convenor, one National Joint Convenor (Admin) and one National Joint Convenor (Finance) (out of which at least one shall be a woman) by consensus, failing which by voting in the presence of National General House.
5. The National Level – Core Working Committee may form such teams as may be required for its activities and the discharge of its functions.
6. The Office Bearers of the National Level – Core Working Committee shall be ex-officio members of the National Advisory Board and shall facilitate the proceedings and process of the Board. It shall provide relevant information, material etc as and when required by the Advisory Board.
7. CWC shall adhere and implement the recommendations given by the Advisory Board especially on policy matters which shall be binding.
8. Convenor and Joint Convenor shall be available for the Party work on regular basis.
9. Reconstitute any team or committee.
10. Recall Convenor or Joint Convenor.

(e.2) The National Level Core Working Committee shall have the rights to increase or decrease the number of Core Working Committees at State, District, Block and Panchayat / Municipality level.

(e.3) The area of a Panchayat Unit, Municipality Unit, Block Unit, District Unit and State Unit shall ordinarily be the same as that of an Administrative area at each level. The area of State Units of the Party shall conform to the States and Union Territories mentioned in the Constitution of India.

(e.4) The term of each organ of the Party, be at any level, shall be for a period of three years.

f. National Advisory Board

The main objective to create an Advisory Board at national level is to seek expertise outside of  the working of the party. Advisory board members shall provide the party with knowledge, understanding and strategic thinking of the socio-economic and political needs and ever changing and demanding scenario within national and international arena and the overall management of the party.

Composition, Roles & Functioning of National Advisory Board (NAB)

1. NAB Shall be composed of minimum 3 members and can be expanded to maximum 50 members headed by the Chief Advisor depending upon the need and demand of the CWC at various levels of party operations and functions.
2. NAB Shall be composed of accomplished experts working, retired or otherwise from various sectors, fields, professions, social workers and activists etc., and shall offer innovative advice and dynamic perspectives. They shall meet once on quarterly basis and shall provide strategic direction, guide quality improvement, and assess program effectiveness etc.
3. Members of NAB shall be appointed for specific terms of two years, whereas the tenure of the Chief Advisor shall be of five years. The CWC can reappoint the members of the Advisory Board for subsequent tenures, if deemed fit, in close coordination with the
   Chief Advisor.
4. NAB Shall give focus to or sometimes challenge research and intelligence work being done in the party, thus avoiding groupthink and giving direction on big and larger picture of the socio-political issues.
5. NAB Shall provide strategic advice to the CWC of the party. The recommendations shall be binding, adhered and implemented by CWC. It shall not have authority to vote on party matters or bear legal fiduciary responsibilities.
6. As an external group, NAB shall provide non-biased information and advice to CWC of the party.
7. The persons in the Advisory Board may and may not be member(s) of the party.
8. The CWC shall have the power to nominate, select and remove Advisory Board members as per the need and demand of the party with a prior notice of 15 days in writing provided such decision has been passed by the CWC with 2/3rd majority.
9. The CWC shall ensure that the size of the Advisory Board remains efficient and manageable at all given point of time.
10. The members of Advisory Board can resign from the Advisory Board by giving 1 month notice to the CWC and the CWC shall accept or reject the request in writing within 10 days of receipt of such notice.
11. The members of Advisory Board shall be of voluntary in nature and shall not be paid any honorarium for their advice or involvement in the party, however, the CWC shall have the right to decide on compensation to the Advisory Board members as and when it deems right.
12. The NAB shall have the additional role of overseeing and ensuring fair conduct in the internal election process of the party.

Broad roles and responsibilities but limited to of Advisory Board members:

• developing an understanding of the socio-economic and political trends
• provide “wise counsel” on issues raised by CWC/Party workers etc
• provide unbiased insights and ideas from a third point-of-view (not involved in the day-to-day operation of the party)
• encourage and support the exploration of new social-economic and political ideas
• act as a resource for party in mobilising donation/funds and members
• provide social networking platform for CWC and the party
• encourage the development of a governance framework that enable sustainable growth of the party
• monitor party performance and suggest remedial actions
• impose challenges to CWC and Party functionaries that could improve the day-to-day business of the party

ARTICLE V: OFFICE BEARERS OF THE PARTY

A. The following shall be the Office Bearers of the Party at various Levels:

a) Primary Level – Convenor, Joint Convenor(Org.) and Joint Convenor (Finance).
b) Block Level – Convenor, Joint Convenor (Org.) and Joint Convenor (Finance).
c) District Level – Convenor, Joint Convenor (Org.) and Joint Convenor (Finance).
d) State Level – Convenor, Joint Convenor (Org.) and Joint Convenor (Finance).
e) National Level – National Convenor, National Joint Convenor (Admin), National Joint Convenor (Finance)

B. Power and Function of the Officer Bearers

a. Convenor

The Convenor shall be the overall in-charge of functioning of the Party at the concerned Level and shall occupy the position as that of a President like in other political parties.

b. Joint Convenor (Org / Admin) at all levels shall

1. Facilitate and organize the meetings of the Unit, record minutes and share progress report on the decisions taken and implemented across the unit.
2. Implement and execute the decisions of the Party and carry out all such work as assigned from time to time.
3. For managing the day to day affairs of the Secretariat at the concerned Level.
4. For maintaining records and keeping minutes of the meetings at the concerned Level.
5. Carrying out all such work as given to him/her by the Party from time to time.

The Joint Convenor (Org / Admin) shall occupy the position as that of a General Secretary like in other political parties and shall represent Party for all legal purposes.

c. Joint Convenor (Finance) at all levels shall

1. Ensure that the accounts of the Party are properly maintained and are audited by an Auditor on the panel of CAG.
2. Ensure that all statutory compliances regarding accounts and Party funds are duly made.
3. Ensure that audited annual accounts of the Party are submitted to the Election Commission of India within six months from the end of the Financial Year.

The Joint Convenor (Finance) shall occupy the position as that of a Treasurer like in other political parties.

d. Terms of the Office Bearers

No member shall hold the same post as an office bearer for more than two consecutive terms of three years each. However, one may seek re-election after a gap of 3 years again and hold the post for two consecutive terms if elected.

ARTICLE VI: INTERNAL PARTY ELECTION PROCESS

1. For internal democracy, the party shall conduct internal elections to appoint members at various positions from time to time.
2. The Advisory Board shall be vested with the authority to call for nomination, re-election, smooth conduct and shall be entrusted for appointment of election officers, office bearers as per norms decided from time to time.
3. The Advisory Board shall call in for election 3 months before the end of each tenure, post of the office bearers. A formal notice shall be issued across the party for information and necessary action.
4. The detailed ERP for complete operationalisation of the party functions at different levels shall be put in place for digital operation with the undermentioned process:

1. The Active Members of Primary level. i.e. Gram Panchayat or Municipality Ward shall form the Primary Level Core Working Committee alongwith Office Bearers as per Article IV A (i) (a).
2. The Block level General House shall comprise of 2 members from each Gram Panchayat / Ward elected / nominated by the Primary level Core Working Committee and the same shall elect the members and Office Bearers of the Block Level Core Working Committee as per Article IV A (i) (b).
3. The District level General House shall comprise of 2 members from each Block elected / nominated by the Block level Core Working Committee and the same shall elect the members and Office Bearers of the District Level Core Working Committee Article IV A (i) (c).
4. The State level General House shall comprise of 2 members from each District elected / nominated by the District level Core Working Committee and the same shall elect the members and Office Bearers of the State Level Core Working Committee Article IV A (i) (d).
5. The National level General House shall comprise of 2 members from each State elected / nominated by the State level Core Working Committee and the same shall elect the members and Office Bearers of the National Level Core Working Committee Article IV A (i) (e).
6. The election process to various offices of the party shall be democratic, no office will be hereditary or held permanently, the functioning of the party shall be democratic and the decision making process shall be by way of majority views of the representative bodies of appropriate level. Nomination to any organ, if any, at any level shall not exceed 1/3rd of the total number.

Declarations:

1. Declared that the Party shall hold regular elections to all offices and office bearers right from Primary Level to National Level periodically not beyond the period of THREE YEARS (3 Years).
2. Declared that the Party shall continue to contest the elections conducted by the Election Commission and if the Party does not contest the elctions continuously for six years, the Party will be taken off the list of registered parties.

ARTICLE VII: CODE OF CONDUCT, DISCIPLINE AND DISPUTE RESOLUTION

A. Code of Conduct

a. Every member of the Party shall abide by the following Code of Conduct:

1. A member shall not get engaged in any immoral or illegal activity as would tarnish the image of the Party or such conduct as would bring disrepute to it.
2. A member shall not undertake any activity, which is in violation of or is contrary to the objectives of the Party as set out in this Constitution or is contrary to the official policy of the Party.
3. A member shall not violate any Rule made by the Party or disobey any direction given by it.
4. A Member shall be free to express their own opinion within and outside the party, unless there is a specific direction to the contrary by the Party for a specified period. Mere expression of difference of opinion will not be considered as violation of Code of Conduct unless it violates the Objectives of the Party.
5. The official statements on behalf of the Party on any platform shall only be delivered, spoken by the authorised Party Spokes Person only. Any Member giving statements on behalf of the Party without authorisation shall attract disciplinary action by warning, penalty or expulsion.

b. Without prejudice to the generality of the above, an office bearer must also:

1. Not involve in any corrupt practices.
2. Not have any pending criminal case of a crime involving moral turpitude or should not have been convicted of any such crime in the past.
3. Not be a part of any organization which spreads disharmony on basis of religion or caste or promotes untouchability.
4. Not indulge in any kind of drug addiction or drunken behaviour.
5. Make an annual declaration of family’s annual income and assets correctly to the Party.

B. Authorities for Disciplinary Action

1. Complaints alleging violation of Code of Conduct, Discipline and Dispute Resolution (a) and (b) against office bearers and Members of Parliament / State Legislature / Corporations / Panchayats Shall be dealt with the following:
   

   National Level	Party Grievance Cell
   State Level	State Grievance Cell
   District Level	District Grievance Cell
   Block Level	Block Grievance Cell

2. Complaints in respect of alleged violation of Code of Conduct, Discipline and Dispute Resolution (a) and (b) and any other matter including internal disputes, grievances etc. shall be dealt with by the Disciplinary Committees to be constituted by the National Level Core Working Committee at the National Level, State Level, District Level and below, as per regulationsframed by the National Level Core Working Committee.
3. The orders passed by the State, District and below, Disciplinary Committees would be appealable to the next higher level in the hierarchy. No appeal against the order of the Party Disciplinary Committee would have the right to seek review of that order.
4. The orders passed by the Party, State, District and below shall be binding and shall be implemented within four weeks of the passing thereof.
   v. The Disciplinary Committee at the National Level, State Level and District and below shall comprise of three persons to be nominated by the National Unit / State Unit / District Unit, as the case may be.

C. Penalties

Disciplinary action may result in penalties ranging from warning, suspension or expulsion from the Party. No disciplinary action shall be taken against a member without being heard.

In case disciplinary action is proposed against a member of District or State Level Core Working Committees, the penalty will be imposed only after approval by the State or National Level Core Working Committee respectively.

ARTICLE VIII: RULES FOR CONDUCT OF BUSINESS

A. MEETING

1. The respective Convenors shall chair meetings of the National/State/District/Block/Primary Lever Core Working Committee. In the event of the Convenor not being available, the meeting shall be chaired by the Joint Convenor (Admin) and by someone elected unanimously in case of absence of the Joint Convenor (Admin) too.
2. The Core Working Committees at various Levels shall meet at least at the following intervals:
   Primary Level: Once in a month
   Block Level: Once two months
   District Level: Once in three months
   State Level: Once in four months
   National Level: Twice a year
3. If required, a meeting of a the Committees may be requisitioned by 1/4th of the members of the concerned Core Working Committee.

B. QUORUM

Quorum for all meetings shall be one-third of the strength of the concerned body. If the Quorum is not complete at the appointed time, those assembled will wait for a maximum time of 90 minutes. If the required Quorum is still not available, the meeting shall be adjourned. A new meeting shall be convened and there shall be no need of a Quorum for a meeting at that time.

There shall be no requirement for a Quorum in case of Emergency or Extraordinary meetings. However, resolutions passed in such meetings shall be required to be ratified in the next ordinary meeting of the concerned body.

C. NOTICE

1. The notice period for Ordinary meetings of various bodies shall be as under:
   Primary Level:  2 Days
   Block Level:  2 Days
   District Level:  10 Days
   State Level: 15 Days
   National Level: 21 Days
2. Emergency meetings of the District/State/National Committees may be convened by the concerned Convenor by giving such notice as deemed fit. The above time periods would not be applicable for such meetings.
3. Members may attend meetings of the District/State/National Committees either in person or via video/teleconference.

D. DECISION MAKING

All decision at all Levels in any meeting shall be taken by consensus, failing which by a majority vote. However, approval of 2/3rd of members, present and voting, shall be required for a resolution for amendment of the Party Constitution and/or decision to merge, split or dissolve.

E. MINUTES

The party shall maintain Minutes of all the Meetings of all its Core Working Committees.

ARTICLE IX: PARTY FUNDS AND ACCOUNTS

A. Collection of Funds

1. Funds shall be collected by means of membership fee, voluntary donations, sale of party material, cultural programs and other events and programmes, etc.
2. Only such persons, as are authorised by the respective Committees, shall
   receive the funds.

B. Donation and Membership Receipts

1. Fund collection receipts will be printed, numbered and issued at the National and State Levels only.

C. Bank Account

1. The Party shall open such number of bank accounts and at such places as considered necessary.
2. There shall be two authorized signatories for each Bank account namely the Joint Convenor (Finance) and Joint Convenor (Admin/ Org) .
3. All receipt shall be deposited in the bank accounts of the Party and all expenses shall be routed through such bank accounts.

D. Utilisation of Funds

1. The funds received by the Party shall be utilised for meeting the political objectives of the Party.
2. The funds shall be utilized by the concerned Core Working Committees. The National Core Working Committee may frame regulations governing the utilization of funds.

The Accounts shall be maintained on accrual basis. The Details of all donations and expenses
will be made transparent.

ARTICLE X: AMENDMENT OF CONSTITUTION

This Constitution, barring ‘Objectives of the Party’ thereof, can be amended by the National General Assembly provided that the amendment has the approval of 2/3rd of its members present and voting after due notice to all the members. For this purpose, a meeting of the National General Assembly shall be convened within 30 days of a resolution for amendment bearing the signatures of at least 50% members of the National Core Working Committee.

However, the power of amendment cannot be exercised in a manner so as to bring the amended Constitution in conflict with the statutory provisions or guidelines issued by the Election Commission of India from time to time.

ARTICLE XI: MERGER SPLIT AND DISSOLUTION

1. Decision regarding merger, split and dissolution shall be taken at a Plenary Session comprising of all office bearers of all organs at every level.
2. The quorum for the meeting of the Plenary Session shall be 50% of the persons entitled to participate in the Plenary Session.
3. A resolution in respect of merger or split or dissolution to be effective shall require the approval of at least 2/3 of the persons present and voting.

ARTICLE XII: INTERPRETATION OF THE CONSTITUTION

The National Core Working Committee alone shall have the power and authority to interpret this Constitution and the regulations framed there under. The Decision of the National Core Working Committee in respect of above shall be final and binding unless it is overturned by the National General House in its next meeting.

ARTICLE XIII: MISCELLANEOUS PROVISIONS

1. No person shall be a member of two Core Working Committees.
2. If someone is member of any Core Working Committee of the Party, none of theimmediate family member can become an Office Bearer (Convenor, Joint Convenor (Admin) and Joint Convenor (Finance) at any level of the Party.
3. Any member who does not attend 3 successive meetings of any Core Working Committee without prior intimation shall cease to be a member of the concerned Core Working Committee on passing of resolution to this effect.
4. The National Core Working Committee shall frame Regulations for filling the vacancies caused by resignation, expulsion or death of a member of a Core Working Committee.
5. The National Core Working Committee shall lay down norms and special arrangements to be put in place for merger of new organisations or parties within the Party.
6. A position of ‘Guardian’ shall be created by the CWC with 2/3rd majority for a period of three years with a role of ensuring that the party doesn’t deviate from its core principles & ethics. In the matters / circumstances like…
   1. When there is difference of opinion between the Advisory Board and the Core Working Committee and not coming to the logical conclusion;
   2. When the Advisory Board and the Core Working Committee approach the Guardian for the opinion on any matter
   3. When a significant number of the Advisory Board and / or the Core Working Committee members represent (s) some concerns on the policy initiatives of the party or decisions of the Advisory Board and / or the Core Working Committee
   4. When there is any prima – facie evidence established in case of  deviating from the core principles and values of the party at any level of the party and the same gets ignored by the disciplinary organs of the party, the Guardian shall take cognizance after proper dialogue with the CWC / Advisory Board and the Guardian’s decision in such cases shall remain final and binding.
7. The party shall promote formation of Advisory Boards at the national and state levels, wherever it forms the government, in order to support the government(s) in devising unbiased and good-for-all policies as per needs of the country and the states.
8. The Party shall not in any manner promote or instigate or participate in violence
9. The party shall contest elections conducted by the Election Commission within 5 years of registration.
